Sometimes it becomes necessary for political or managerial reasons for the Council to part company with the Clerk. Perhaps the Clerk will resign and claim Unfair (Constructive) Dismissal. What a Parish or Town Council needs in these circumstances is an independent legal adviser, who can broker a deal between the Council and the departing or departed Clerk and bring the matter to a speedy and tidy conclusion. We try to arrive at a conclusion which retains the dignity of both parties, if at all possible. It is important also to arrive at a lawful conclusion, i.e. not paying out illegal quantities of money to solve the problem.
It is a difficult task, but it can be made to work ~ and it can be made to work legally. |
